Marriage Registration in Kharar and Zirakpur: Process and Documents
Marriage registration is the process of obtaining an official government certificate confirming that a marriage has taken place. While registration is not mandatory for the marriage itself to be valid in India, it is essential for passport applications, visa applications, immigration, bank nominations, insurance claims, and various government services. In Kharar and Zirakpur (both in Mohali district, Punjab), the process falls under Punjab's marriage registration rules. Here is everything you need to know.
Is Marriage Registration Mandatory?
The Supreme Court of India, in Seema v. Ashwani Kumar (2006), directed all states to make marriage registration compulsory. Pursuant to this, Punjab enacted the Punjab Compulsory Registration of Marriages Act, 2012, which makes it mandatory for couples who reside in Punjab to register their marriage within 90 days of solemnization.
Failure to register within 90 days does not make the marriage invalid — but it may attract a penalty. More importantly, an unregistered marriage creates practical difficulties when you need the certificate for passport, visa, or legal proceedings.
Two Types of Marriage Registration in Kharar/Zirakpur
1. Registration Under Hindu Marriage Act (Section 8) For couples married under the Hindu Marriage Act (Hindus, Sikhs, Buddhists, Jains). This is a registration of an already-solemnized marriage — you get a certificate confirming the marriage that already took place at the gurdwara, mandir, or any ceremony.
2. Marriage Under Special Marriage Act (Section 15) For couples marrying civilly (court marriage) — the registration and solemnization happen simultaneously before the Marriage Officer. This is particularly common in Kharar and Zirakpur for inter-religion or inter-caste couples.

Both husband and wife must provide:
| Document | Details |

For marriages that took place many years ago (delayed registration), additional evidence (joint photographs, school records of children, old utility bills) may be required.
Documents Required for Court Marriage (Special Marriage Act) in Kharar/Zirakpur
For court marriage (registration before the Marriage Officer):
- Age proof (Aadhaar, birth certificate, 10th marksheet, passport)
- Address proof (must show residence of 30 days in the jurisdiction)
- Passport-size photographs (5–6 each)
- Affidavit of marital status (single/divorced/widowed)
- Proof of divorce / death certificate (if previously married)
- 3 witnesses with ID proof
Online vs. Offline Registration in Punjab
Punjab now offers online application initiation for marriage registration. The basic process:
- Apply online at the edistrict portal
- Upload required documents
- Get an acknowledgement and appointment date
- Appear before the Registrar/SDM on the appointed date for verification
- Receive the marriage certificate (often on the same day or within a few days of verification)
For court marriages (Special Marriage Act), the process is still primarily in-person at the SDM office, as the Marriage Officer must personally verify and record statements.
How Long Does Marriage Registration Take?
- Hindu Marriage Act registration (after ceremony): 1–4 weeks from application date
- Special Marriage Act (court marriage): Minimum 30 days (due to the mandatory notice period) + a few days after the notice period for solemnization and certificate
- Tatkal / urgent registration: Not available as a standard option; exceptional circumstances may be taken up
Common Issues and How a Lawyer Can Help
Issue 1: Old marriages, missing documents Couples who married years ago and need to register for passport/visa often lack the marriage invitation, photographs, or witnesses. A lawyer can help draft appropriate affidavits and gather alternative evidence.
Issue 2: Religious marriage + Court marriage Some couples do a religious ceremony and also want court marriage for legal documentation. A lawyer advises on whether to do both (recommended) and handles the paperwork.
Issue 3: Name change after marriage Marriage registration is the first step for a name change in Aadhaar, passport, PAN, and other documents. A lawyer helps with the full chain of documents.
Issue 4: Rejection of application If the SDM office raises objections or requires additional documents, an advocate can respond to the SDM and assist with resolving the issue.
