The legal basis for injunctions in property cases is Order 39, Rules 1 and 2 of the Civil Procedure Code, 1908.

Types of Injunctions

1. Temporary Injunction (Interim Injunction) Granted during the pendency of the main suit and remains in force until the suit is decided. This is the most critical relief in property disputes because it preserves the status quo while the matter is being decided by the court.

Sub-types:

  • Ad-interim injunction: Granted at the very first hearing of the injunction application, without notice to the other side, when the court is satisfied that the situation is extremely urgent. Lasts until the next hearing date.
  • Temporary injunction: Granted after hearing both sides. Remains in force until the suit is disposed of.

2. Permanent Injunction Granted as part of the final decree in the suit — after a full trial on merits. It permanently restrains the defendant from interfering with the plaintiff's property rights. This is the ultimate relief but takes years to obtain through a full trial.

3. Mandatory Injunction Orders the defendant to positively do something — for example, remove an encroachment, restore a demolished wall, or hand over possession of property.

When Can You Get an Injunction?

The court grants a temporary injunction under Order 39 only if the applicant establishes:

1. Prima Facie Case The plaintiff must show that they have a legitimate, arguable claim — not that they will definitely win, but that they have a serious question to be tried.

2. Balance of Convenience The court weighs the harm to the plaintiff if the injunction is NOT granted versus the harm to the defendant if it IS granted. If the defendant will suffer only minor inconvenience but the plaintiff faces irreparable loss, the balance favours granting the injunction.

3. Irreparable Injury The plaintiff must demonstrate that without the injunction, they will suffer harm that cannot be compensated in money — for example, a unique property being sold to a bona fide purchaser who then cannot be disturbed.

Scenario 1: Seller Trying to Re-Sell an Already-Agreed Property You have paid advance money for a plot in Zirakpur. The seller is now trying to register the same plot with another buyer. You need an injunction immediately before the second registration happens.
